  1. Court case

Settled US children's privacy class action over Subway Surfers

In McDonald v. Kiloo A/S, filed in July 2017 in the US District Court for the Northern District of California against Kiloo and SYBO, parents alleged that Subway Surfers contained advertising software that collected data from children under 13 for commercial purposes without parental consent. On 12 April 2021 Judge James Donato approved SYBO's settlement, making no finding of liability or wrongdoing. For three years in the US, SYBO agreed to add an age gate that asks players for their age; for players who say they are under 13, to collect data only in compliance with the children's privacy law COPPA, use only ad software that its ad networks say can serve them contextual (non-targeted) ads, and not track their street-level location or send them push notifications; and to delete certain previously collected personal data. Class members received no money and kept the right to sue for damages; the plaintiffs' lawyers asked SYBO for $525,000 in fees and expenses, which SYBO did not oppose.
