  1. Labour

Gave staff notice ahead of closing

Kiloo's design director said on LinkedIn that the studio's roughly 100 staff had been given notice of termination by the end of June 2023 and that it was closing after 23 years; other employees corroborated this. Kiloo did not publicly give a reason.

  2. Court case

Settled US children's privacy class action over Subway Surfers

In McDonald v. Kiloo A/S, filed in July 2017 in the US District Court for the Northern District of California, parents alleged that Subway Surfers contained advertising software that collected data from children under 13 for commercial purposes without parental consent. On 12 April 2021 Judge James Donato approved a settlement in which Kiloo admitted no liability and agreed, to the extent it still had publishing responsibility for the game, to add an age gate that asks players for their age, collect data from players who say they are under 13 only in compliance with the children's privacy law COPPA and use only ad software that its ad networks say can serve them contextual (non-targeted) ads, and delete certain personal data collected when it published the game. Class members received no money and kept the right to sue for damages; the court ordered Kiloo to pay $654,365 in the plaintiffs' lawyers' fees and expenses and $833 to each of the three named plaintiffs as service awards.
